PLEASE READ & INITIAL EACH FIELD.
Release, hold harmless, waive and discharge Beauty By Jaye and its staff, agents, employees, contractors, affiliates and representatives (together with their respective heirs, administrators and assigns) (collectively, the “Company”), of and from any and all claims, losses or damages (including without limitation, any direct or indirect damages) sustained by me, by any guest of the Event or any other third party in connection with, or as a result of this Agreement or any products or services provided by the Beauty By Jaye. Other than as expressly provided herein, the products and services provided under this agreement are without warranty, representation or condition of any kind, oral or written, express or implied, in fact, or in law, including without limitation, the implied warranties or conditions of merchantable quality and fitness for a particular purpose.
Acknowledge that there are certain risks involved in participating in the Event, in addition to the usual risks and dangers inherent in any physical activity, including without limitation allergic reactions, slips, falls, or as a result of physical contact with another person.
NOTIFICATION OF ALLERGIES
Warrant that I have notified Beauty By Jaye of any allergies I may have. I acknowledge that while Beauty By Jaye will make every commercially reasonable effort to accommodate requests for alternate products, Beauty By Jaye shall not be held responsible for any allergic reactions to any of the products used during makeup applications.
You hereby agrees to indemnify and hold Beauty By Jaye and its affiliates, subcontractors and agents (and each of their shareholders, officers, directors, employees and contractors) harmless from and against any and all third party claims and resulting losses and damages including, but not limited to, reasonable legal and accounting fees, fines and expenses, resulting from, relating to or arising out of: (a) any products or services provided hereunder; and (b) the Customer Materials, including but not limited to infringement of intellectual property rights thereby.
Beauty By Jaye shall not be liable to you for any indirect, consequential, special, exemplary or incidental damages whether in contract, tort or otherwise, arising from or relating to this agreement even if such party has been notified of the possibility of such damages.
I acknowledge and accept by booking with Beauty By Jaye the Release and waiver are in place and active from the date of booking confirmation.
